GENERAL TERMS AND CONDITIONS OF SALE

 

 

The Natsuc company, a company with capital of €10,000 registered in the Antibes Register of Companies (RCS) with the number 843 170 762 and a registered office at 2000 route des Lucioles, Les Algorithmes. Aristote A 06410 Biot, operates the Natsuc website, www.natsuc.com, through which the Natsuc company sells its products online.

 

The buyer will be referred to by the term “you” in this document.

 

 

Article 1: Preamble

 

These general terms and conditions of sale are agreed upon by Natsuc and any non-trading natural person who would like to make a purchase on the website.

 

These general terms and conditions exclusively govern your relationships with Natsuc.

 

Natsuc reserves the right to amend the general terms and conditions at any time. They will be applicable as soon as they are published online.

 

 

Article 2: Capacity

 

You acknowledge that you have full capacity to agree to these general terms and conditions of sale when you make an order on the website.

 

 

Article 3: Products

 

The products subject to the general terms and conditions are those which appear on the website and which are indicated as being sold and dispatched by Natsuc. They are offered for sale while stock lasts.

 

The essential characteristics of the products are described and presented as accurately as possible.

 

 

Article 4: Price

 

The product prices are stated in euros including all taxes. They include VAT and any potential reductions.

 

The product prices do not include delivery charges (postage, packaging and preparation of the package in accordance with current amounts). The total delivery charges will be specified before you confirm your order.

 

If one or several taxes or contributions, in particular environmental taxes or contributions, are created or changed, whether they are increased or decreased, this change will be reflected in the sales price of the products shown on the website.

 

However, a price cannot be changed once the order has been confirmed. Nevertheless, if there is a price error (clearly a ridiculously low price in relation to the product’s actual value) Natsuc may cancel the confirmed order. This is an exceptional measure.

 

 

Article 5: Order

 

5-1: Prior identification

 

To place an order you must identify yourself with your email address and your password. To make your first order you must create an account.

 

When making your first order you choose and enter a username and a password. The system checks that the username is unique. You will be asked for this strictly confidential password each time you make a transaction.

You agree to take care of this username; you must inform us in writing if it gets lost in order to release you from any liability.

If you lose or forget your password, you can click on the “if you have forgotten your password” link and enter your email address. You will receive a link by email to reset your password as your email address will be recognized.

 

 

5-2: Recording and confirming an order

 

Once you  have confirmed your basket, you must choose the delivery address and method and confirm your payment method; this final stage formalizes the sales contract with Natsuc.

 

Natsuc will confirm receipt of your order once it has been confirmed by sending you a confirmation email.

 

Any order implies acceptance of the price and descriptions of the products available for sale. All the information that you provide when placing an order is binding, in particular the information regarding the order recipient (name, address, etc.), and Natsuc cannot be held responsible for any errors made if Natsuc is unable to fulfil and complete the order. For this reason, you should ensure that the recipient or a representative is present on the day of delivery.

 

As soon as the order is dispatched, you receive an email providing the package tracking number and a link that allows you to follow your package delivery in real time on their website (colissimo or another delivery company).

 

 

Article 6: Payment

 

You can pay for your order using a bank card: Visa carte bleue or Mastercard.

 

 

Article 7: delivery and delivery time

 

Delivery charges, to be paid by the customer, are calculated automatically when placing an order.

 

Only French VAT will be applied to deliveries outside France. Products are delivered to the delivery address that you provided when placing your order. The delivery times specified are average delivery times and reflect the time it takes for the postal services to process deliveries for products being sent within metropolitan France.

 

In order for these delivery times to be met, you must ensure that you have provided accurate and full delivery address information (e.g. road number, building, floor, access code).

 

Colissimo:

Preparation time: 1 to 2 working days for any order received before 13:00.

Delivery time: 2 to 3 working days.

Total delivery time from the order confirmation date: 3 to 5 working days.

 

Orders are received Monday to Friday (excluding public holidays). Orders placed on Saturday and Sunday will be processed on Monday or Tuesday depending on available stock.

 

 

Article 8: Complaints

 

Natsuc makes every effort to meet your needs as best as possible. If you have a complaint to make, you can send it by email to the address below or directly via the “Contact us” tab on our website specifying the relevant order number.
If the product has not been delivered, for any reason other than force majeure or the cases mentioned above (recipient is absent, incorrect information, etc.), the sale may be cancelled and the buyer may obtain a refund for the price paid, excluding any other compensation, damages and interest.
You are reminded that you enjoy the legal guarantee of conformity provided for in Article L211-4 et seq. of the French Consumer Code and the legal guarantee relating to the consequences of faults or hidden defects provided for in Article 1641 et seq. of the French Civil Code. As a consumer, you also enjoy a statutory period of 14 days to exercise, if necessary, the right of withdrawal referred to in Article L 121-20-12 of the French Consumer Code.
In any event, in the event of non-conformity, you can return the article(s) within 7 days, together with proof of purchase, to Natsuc stating whether you would like an exchange or a refund. To help us meet your needs better, please provide the reason for the return on the back of the delivery slip.
Refunds are made by cheque or bank card. The time it takes to provide a refund will not exceed 30 days from the receipt of your request for a refund.

 

 

Article 9: Client files

 

Our website was the subject of a prior declaration to the French Data Protection Authority (CNIL), registered with the number 14 -10-137. These data are processed and stored under conditions to ensure their security.
The data that Natsuc collects on the website is used by us and is required to manage your order and our commercial relationships. As a customer, you will receive our commercial offers unless otherwise notified (right to object).
Some data are optional for processing orders; you can choose to complete the relevant field or not.
In accordance with the French Data Protection Law of 6 January 1978, you have, at all times, the right to access, correct and object to any of your personal data by writing by post and proving your identity to Natsuc.

 

 

Article 10: Prohibition of offline sales

 

Are products are intended to be sold only on our website. Therefore, it is prohibited to purchase our products for the purpose of reselling them. As well as damaging our brand and the integrity of our products, anyone who commits such actions could incur civil liability and, if applicable, could be liable to prosecution.

 

 

Article 11: Intellectual property

 

All the material on the website, whether visual or sound material, including the underlying technology, are protected by copyright for trademarks and patents. When accessing the website, the customer is prohibited from copying or downloading all or part of its content, without the prior express authorization of Natsuc.

 

 

Article 12: Force majeure

 

Natsuc cannot be held liable in any cases of force majeure related to unavoidable, unforeseeable, external events. Recognized disasters or storms, strikes by logistics service providers, or any other event that is likely to disrupt the smooth movement of goods and data flows are considered to be cases of force majeure.

 

 

Article 13: Applicable law and disputes

 

These general terms and conditions are subject to French law.
In the case of a dispute, an amicable resolution will be sought first before any legal action. For this purpose, we request that you contact our customer service by post to the following address: Natsuc, 2000 route des Lucioles, Les Algorithmes. Aristote A 06410 Biot.

 

If an amicable resolution is not reached, any legal action will be brought before the Antibes commercial court.
